In our practice, we often see accidents involving two cars or a car and pedestrian where one car swerves and hits the other car. Usually, the car at fault crosses over a yellow line and skid marks can be used to prove who was at fault. Also, where pieces of the vehicles land after the accident can prove who was at fault. Without such information, it can be a he-said-she-said situation, which makes proving who was at fault difficult. Remember, you have to be able to prove the other party was at fault in causing the accident that caused your injuries to collect in Ohio. Often, you can access the car’s black box to see what the car was doing in the last 5 to 10 seconds before the crash. these black box downloads are typically used in larger accidents with severe injuries.
