What constitutes wrongful death?

In any civil case, plaintiffs must prove certain elements. For a wrongful death claim, generally the following four elements must be proven:

  • The conduct of the defendant caused, or partially caused, the victim’s death
  • The defendant is liable for the victim’s death through negligent (careless) conduct.
  • The victim has surviving family members
  • Financial loss/damages resulted from the victim’s death
