According to the police report and court documents (Case Number 11-cv-0746, Court of Common Pleas, Wayne County, Ohio, Judge Wiest), Zach was traveling west on SR 604 on his motorcycle. Mr. Schmitt was traveling south on TR 50 in a Toyota Camry turning east on SR 604. According to police, Mr. Schmitt failed to yield and pulled out into the intersection. Zach tried to avoid Mr. Schmitt but hit his car causing him to eject from his motorcycle. Due to the serious nature of his injuries, Zach was life flighted to Akron General Hospital.
As a direct and proximate cause of the collision, Zach suffered catastrophic injuries, including a spinal cord injury leaving him a permanent paraplegic. He required extensive physical therapy to help him function in day to day activities and regain strength.
According to court documents, medical bills from the collision, in addition to lost wages and other economic damages were calculated by financial experts to exceed $5,000,000.00. Chester Law Group was forced to file a lawsuit (Case Number 11-cv-0746, Court of Common Pleas, Wayne County, Ohio, Judge Wiest) in the matter and after extensive litigation a settlement was reached. The settlement amount is confidential.
